By accessing or using the Onboardia platform ("Service"), operated by Onboardia ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including administrators, HR personnel, and employees invited to use the onboarding portal.

2. Description of Service

Onboardia is a cloud-based employee onboarding platform that enables businesses to manage new hire onboarding through digital forms, document collection, e-signatures, checklists, and automated workflows. The Service is provided as a software-as-a-service (SaaS) solution.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Collect or store personal data about other users without their consent
  • Use the Service for any illegal, harmful, or fraudulent purpose

5. Subscription Plans and Payment

Onboardia offers various subscription plans, including a free tier with limited features. Paid plans are billed on a monthly basis. By selecting a paid plan, you agree to pay the applicable fees.

  • Fees are charged at the beginning of each billing cycle
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

6. Data Ownership and Licensing

You retain all rights to the data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to process, store, and transmit Your Data solely to provide the Service to you.

We do not sell, rent, or share Your Data with third parties for their marketing purposes.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Onboardia and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

8. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We decide to discontinue the Service

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service ceases immediately.

10. Limitation of Liability

To the maximum extent permitted by law, Onboardia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar issues transmitted through the Service by any third party

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
